  1. The phrase "J&M LOCK, Inc" & the words "Site", "website", "us" & "we", as used in this Policy, pertains to the business known legally as J&M Lock, Inc, incorporated under the laws of the State of Montana and licensed in Manhattan, Montana, www.jmlock.com and any representative thereof.
  2. The terms "you" & "yours", as used in these Policies, pertains to any person that uses www.jmlock.com to: find and/or gather information, price compare, purchase products or services, including any person that cancels any shopping cart or invoice.
  3. The term "shopping cart", as used in these Policies and on this site, pertains to the area on our system that keeps the items you have chosen to purchase until such time you decide to check out, or cancel the order.

II. ACCOUNTS WITH J&M LOCK, INC

  1. You must be at least 18 years old to purchase from J&M LOCK, INC.
  2. In order to give you the best online payment security when ordering from J&M LOCK, INC, we require all of our online customers to provide us with: Full name (as shown on your credit card), address (the address to which your credit card bill is sent to), phone number, company information (if you are representing a business), e-mail address and a password that you choose. You do not need to provide a password if you do not wish to register on our site. Please see our Privacy Policy for more detail about what we do with your personal information.
  3. Your email address will be used to contact you in the event of changes made to our site or our services that may affect your use of our site. This may include, but is not limited to: Changes to the policies listed on this page; changes to your account; or issues with our site that may affect your access to our site and your stored information.
  4. J&M LOCK, INC will store your personal information only so that you may access your account easier when you return to our Catalog. You should only need to enter all of your information the first time you attempt to check out. On subsequent visits, you will only need to enter your e-mail address and password.   6. We accept MasterCard, Visa, Discover/Novus, American Express, PayPal , Google Checkout & business checks. We DO NOT ACCEPT PERSONAL CHECKS.
  7. A $25.00 fee will be charged on all returned business checks.

III. TAXES

  1. You will be responsible for paying all necessary taxes.
  2. We are required to collect sales tax if you live in CA, CT, FL, MA, MD. If you live in another state that requires sales tax, it is your responsibility to pay the tax due if we don't charge you.
  3. If you are part of a tax exempt organization you must fax us a copy of your exemption certificate or you will be charged sales tax. We cannot prevent our site from charging you sales tax if you are exempt so please contact us to order.
  4. We will not refund any sales tax paid.
  5. All orders to Canada are subject to duties, taxes and other fees which YOU are responsible for.

IV. SHIPPING REQUIREMENTS

  1. J&M Lock, Inc will only ship to addresses in the United States & Canada.
  2. 99% of all orders will arrive at the shipping destination in 2 days. Orders are shipped the same day if received before 4:00 PM Eastern Time. This excludes Alaska, Hawaii, Puerto Rico, Canada as well as orders that must be shipped from a warehouse that is not near your ship to address due to lack of inventory.
  3. Orders are shipped United Parcel Service (UPS) or best route of our choice, unless you request otherwise, in which case you could be subject to a higher shipping cost. We will inform you of such a rise in cost when you request such a change in shipping method. We reserve the right to modify the shipping method to serve you better.
  4. The ship to address must not be a Post Office Box. It must also not be a Post Office Box that is part of a non-USPS Post Office, unless you specify USPS during checkout.
  5. At this time we can ship to Military Post Office Box Numbers. However, this may change your shipping cost & may cause a delay in your shipping time. You MUST select the appropriate shipping method during checkout.
  6. The 'Billing' address MUST exactly match your credit card billing address. We cannot ship to any address other than your credit card billing address or the address pre-printed on your check. If your billing address is a United States Post Office Box (USPS PO BOX), please provide other proof that you are legally using the credit card or check you have requested we accept. You may contact us at:

  7. J&M LOCK, INC will pay shipping on orders over $500.00, unless you specify Next Day Shipping or delivery by USPS on your order, or if the shipping address is APO, FPO, HI, AK or other address that is not in the continental United States.
  8. ALL ORDERS TO CANADA ARE SUBJECT TO SHIPPING COSTS
  9. We will also pay shipping on select stock items. Special order items do not qualify for free shipping.
  10. Next Day delivery will only be honored if your order is placed and received no later than 4:00PM Eastern Monday through Thursday. Saturday delivery is not available. Please call us before completing an order where you want Next Day delivery.
  11. Large safes are TRUCK SHIPPED ONLY, unless otherwise specified in the full description of the safe. We can only ship safes to addresses in the Continental United Sates. Under no circumstances can safes be shipped outside of the continental United States.
  12. Shipping costs to Hawaii, Alaska, Puerto Rico & Canada will be slightly higher. If you select Free Shipping on your order it may be canceled so please select the appropriate shipping method to include this cost in your order during checkout.
  13. We can NOT accept credit card orders from any overseas country, except Canada, unless the card is drawn on a US bank. If you require shipment to a foreign country, you MUST contact us first.
  14. We cannot charge shipping to a third party UPS, FedEx or DHL account.

V. CANADIAN ORDERS

From April 7, 2010 until May 20, 2010 we will be unable to accept orders from Canadian customers.


To help prevent fraud we will require some specific items before we can process and ship an order that originated from or is being shipped to Canada.
  1. You must print, fill out and send us back this consent form.
  2. We must also receive a copy of your credit card, front and back.
  3. We must also receive a copy of your Province issued ID card or driver’s license. This ID must show your credit card billing address.
  4. If your ID or license doesn’t show your billing address, include a copy of your last credit card bill, making sure that your billing address shows.

  6. You are responsible for any and all duties, taxes and fees related to shipping your order from the US to Canada.
  7. We must have all of the required information prior to shipping any order to Canada. Failure to promptly send us this information may result in the delay or cancellation of your order.
  8. All orders to Canada will require an extra 3-7 business days to ship.

VI. SAFES

  1. As of January 1, 2007, all safes ship FREE. For truck delivered safes, please contact us to make delivery arrangements after you have placed your order online.
  2. This excludes any shipment to Canada. Large safes can NOT be shipped to Canada.
  3. Safes that are delivered by truck shipment must be inspected immediately upon receipt. If your safe arrives damaged, please fill out a report with the carrier before the driver leaves your location. Contact us immediately thereafter. Do not destroy any packaging that the safe was packed in. If you wish to return a damaged safe, please do so in the original packaging.

    DO NOT E-MAIL US WITH DAMAGED FREIGHT INFORMATION.

    Doing so may cause unnecessary delay in crediting your account. Please see our RETURN POLICY below or contact us by telephone at:

  4. Safes listed as "truck shipped" are shipped on freight trucks, therefore your Ship To address MUST be a location that you can accept the safe.
  5. Truck shipped safes can NOT be delivered to AK, HI, PR or any other location outside of the continental United States.
  6. Large safes may require the use of a forklift, which you must provide.
  7. You must be prepared to unload the safe when it arrives. The truck driver will not wait for unloading arrangements to be made
  8. Residential Ship To addresses will require the use of a lift gate on the shipment truck.

VII. ORDER REQUIREMENTS

  1. As stated in Section II, you must be 18 years old or older to purchase anything from J&M LOCK, INC, either online or in person.
  2. In placing any order with us, you are certifying to J&M LOCK, INC, its owners and distributors that you are 18 or older.
  3. You are also stating that you will not use any item or items purchased from us in an illegal, immoral, or unlawful manner.
  4. You are also certifying that you accept sole responsibility for obeying all local, state, and federal statutes regarding the possession and use of any tools or books that may be regarded as "Locksmith-related", and that J&M LOCK, INC, its shareholders, agents and representatives will be held completely harmless in the event you fail to observe such restrictions.
  5. In addition, you are certifying that you accept full responsibility for any loss or damage that occurs from the misuse of any item purchased herein.

VIII. LOCKSMITH TOOLS POLICY

At J&M LOCK, INC, we are very serious about selling certain Locksmith-related tools and equipment to anyone, whether purchased online or in person. We make every effort to insure that anyone desiring to purchase such tools is legally authorized to purchase, carry and use such tools BEFORE we ship any such product.

  1. If you desire to purchase tools or other equipment that are specifically designed for use by Locksmiths, you must fax or email us a copy of your Locksmith license, Bonding or other written proof (as listed here) of your intention to use such products. Our fax number is (406) 284-4461. Please include a cover sheet with the items you wish to purchase and, if applicable, include the invoice number that our online catalog will apply to your order after you go to the checkout.
  2. U.S.C. Title 39 Section 3002a specifies that locksmith tools can be shipped via mail only if the buyer can certify that he/she/it can be truthfully regarded as one of the following:

    1. A bona fide locksmith,
    2. A bona fide auto repossessor,
    3. A licensed car dealer,
    4. A lock manufacturer,
    5. A motor vehicle manufacturer, or
    6. A bona fide police officer.

  3. By placing your order for Locksmith Tools, and by sending us the documents we have requested, you are electronically signing this agreement and certifying to us under penalty of perjury that at least one of the above classifications pertains to you. In the absence of this assurance, J&M LOCK, INC will not ship any products you have included on your invoice that pertain to these terms.

  4. Items we accept as proof for the requirements set above in this section are as follows:

    1. A copy of your Locksmith license, which must be assigned by your state, county or city and must include certification from such entity. Certification can be a letter from a state, county or city official that is designated by such entity to assign such licenses. Any letter from such person must be on the letterhead of such entity. We can also accept a copy of a license if the license contains a state, county or city seal or logo; or
    2. A copy of your new or used car dealership license, which must be assigned to you by your state, county or city; or
    3. A copy of your manufacturer's license, which states you can legally manufacture locks, keys, locksmith-related items such as tools and key duplicating equipment, or any such item that is known to be a lock-related product. The copy must be faxed to us from your company fax machine or we cannot accept it as legal; or
    4. A copy of your auto reposessor's license which was assigned to you by your state, county or city; or
    5. A copy of your police officer certification and a letter from your commanding officer on your city, county or state police letterhead stating that you are legally authorized to purchase Locksmith-related tools and/or equipment.
    6. Other certification that we may accept in the absence of any of the above A through E.

IX. RETURNS POLICY

  1. You must contact J&M LOCK, INC upon receiving shipment if the contents are damaged or are incorrect. We will not accept any returns that were damaged during shipment to you if you do not contact us immediately. DO NOT CONTACT THE WAREHOUSE
  2. All returned merchandise including over-shipments, defects, repairs, cancellations, refusals, wrong shipments, etc. must be handled immediately upon shipment, or as soon as possible thereafter.
  3. UNAUTHORIZED RETURNS WILL NOT BE ACCEPTED
  4. All discrepancies (shortages, incorrect shipments, etc.) must be claimed within 5 days after receipt of material.
  5. Safes that are shipped via common carrier (i.e. truck shipment) must be inspected upon receipt. Any claims must be reported immediately.
  6. Price differences must be submitted for verification within 15 days of invoice.
  7. No returns under $50.00 will be accepted.
  8. Special Orders cannot be returned except for manufacturer defect or damaged shipment.
  9. All returns must be in a condition suitable for resale.
  10. Returns must be requested within 30 days of date of receipt of delivery.

X. RETURNS PROCEDURE

  1. Return Authorization Requests (RGA) will be issued for over-shipments, defects, repairs, cancellations and wrong shipments.
  2. No returns will be accepted without an assigned Return Authorization Number.
  3. Contact Customer Service at: (406) 284-4460 to request a return.

    Please provide invoice number, item number & quantity. We also require the reason for wanting to return the merchandise. In the case of defects, a specific description of the defect is required.

  4. Adding merchandise to the return shipment that isn't included in the Return Shipment Authorization will be unacceptable and will not be credited.
  5. There will be a 25% restocking fee on merchandise returned or refused for reasons other than defects or incorrect shipments. If you do not agree to the restocking fee we will not allow you to return any item on your order.
  6. All Pacific Lock products are subject to a 35% restocking fee as per the manufacturer.
  7. All returns are subject to the manufacturer's return policy.
  8. Defective electronics/access control products and key machines are returned directly to the manufacturer upon their approval. Under no circumstance will J&M LOCK, INC accept a returned key machine for credit or exchange that has been used and deemed Not Defective.
  9. Safes may not be returned unless damaged during shipment to you or if you received the wrong product.
  10. Upon receiving an RGA, you have 3 business days to turn all packages containing the items being returned, as listed on the RGA, over to UPS, or other carrier as specified by our supplier.
  11. If you fail to turn over such packages within 3 business days, you will be charged the price as listed on our website for the item(s) being returned as of the day of the charges. If your credit card declines the charge, you will be deemed late on payment and a 2% daily late fee will be assessed until payment is received in full, or until the items are given to the carrier.
  12. You are not responsible for items being returned under our RGA system once the package is turned over to the carrier unless the items in the package are not listed on the RGA, or if the items in the package are deemed beyond a saleable condition by our supplier, unless the RGA is for the return of defective items.

XI. EXCEPTIONS TO RETURN POLICY

  1. Printed materials, such as codebooks, disks, catalogs, computer software or instruction manuals are not returnable.
  2. All electronic devices such as strikes, magnets, access control units, key machines, etc., as well as problems with finishes, are subject to manufacturer's return policy and may be repaired & returned solely at that manufacturer's discretion.
  3. In the case of damaged or opened shipping cartons, a damage report must be filled with the carrier before accepting shipment. Original box must be presented to carrier.

XII. SPECIAL ORDERS

  1. J&M LOCK, INC has the right to refuse any Special Order. Special factory ordering of non-stock items is a service provided to J&M LOCK, INC by its distributors for its customers.
  2. All Non-Stock Special Orders must be accompanied by a letter or Purchase Order written on your company's letterhead stating specifically the exact item numbers and quantities, and accompanied by a 50% partially-refundable deposit at the discretion of J&M LOCK, INC, or paid in full prior to us placing the order with our supplier.
  3. No Special Ordered items may be returned, under any circumstance, with the exception of factory defects & then a Return Authorization Number must be assigned by the manufacturer first.

XIII. WARRANTY

  1. J&M LOCK, INC warranties no product that we sell.
  2. ALL WARRANTIES FOR ANY PRODUCT SOLD TO ANY CUSTOMER ARE GUARANTEED BY THE MANUFACTURER ONLY
  3. Any warranty claim that arises from any product sold to any customer is the responsibility of the manufacturer of that product. Such claim must be directed to the manufacturer of that product.
  4. J&M Lock, Inc will not issue any RGA for any return due to a manufacturer's warranty claim, unless directed by the manufacturer to do so.

XIV. PAYPAL POLICY

  1. We accept PayPal as a payment option.
  2. You must have or sign up for a PayPal account before completing your checkout if you want to use PayPal to process your transaction.

    1. PayPal has a set of policies that you must agree to and follow or we cannot accept nor process your order through PayPal.
    2. PayPal has a privacy policy and a "Terms of Use" that you must read and agree to before using their service.

  3. When ordering from us and using your PayPal account, you are agreeing to the terms listed on PayPal's site and furthermore agree that our privacy policy, terms and other policies, as listed on this page, are in addition to PayPal's; and neither PayPal's policies nor ours cancels the other out.
  4. Your PayPal Account and Address must be verified before we will approve any order paid via PayPal.
